The European Commission has warned again the Czech Republic about its failure to follow rules regarding official controls.
An extra reasoned opinion was sent to the country in connection with Europe’s Infringement procedure. A country in the EU that does not comply with EU law can be sued by the Commission.
A reasoned opinion is the second step in the procedure, following a letter of formal notification requesting additional information and before referrals to the Court of Justice of the European Union. In January 2019, a letter of formal notice was sent to Czech Republic. A reasoned opinion was then issued in July 2019..
Breach EU rules
Czech Republic requires pre-notification of food imports. According to the Commission, reporting the arrival of goods from other member states must not be a systematic process and should only be done when it is absolutely necessary to conduct official controls.
Czech officials decided to conduct a risk assessment and possible official controls on certain foodstuffs that come from other member states each time they enter the country. The notice does not identify the country or product.
Authorities have made it mandatory for operators to inform 24 hours ahead of the arrival of certain foodstuffs at the destination.
The Commission stated that Czech Republic “continuously and systematically” violates EU rules on official control,
The EU country has 2 months to comply with the supplementary reasoned opinions, or the Commission can refer the case to its Court of Justice.
Bulgarian Water Marketing Rules
Bulgaria was also sent a reasoned opinion by the European Commission for not complying with EU marketing requirements for spring and natural mineral waters.
Bulgarian law does not require that the spring name be listed on the label. It also doesn’t prohibit the sale or distribution of spring water and natural minerals originating from the same spring under different trade names.
EU rules were established to remove differences in laws between member states governing spring water and natural minerals to protect consumers’ health, prevent misleading and ensure fair trading.
Bulgaria will have two months to correct the situation before the case can be sent to EU Court of Justice.
